For a long time, secession has been considered as a dynamic extra ordinem that the state has to deal with readily. It was perceived as the unilateral and revolutionary establishment of a new state order simultaneously with the loss of the territorial integrity and the modification of the borders of the state of origin. In this perspective, this chapter analyses how the constitutional law of the European states deals with the claims of political independence of single regions and to which extent domestic law is able to recognize the possibility to modify the external borders without modifying the basic constitutional order.
Per molto tempo, la secessione è stata considerata come una dinamica extra ordinem ovvero come atto unilaterale e rivoluzionario contro l'integrità territoriale e costituzionale di uno Stato. In questa prospettiva, questo capitolo analizza in chiave comparata come le Costituzioni europee gestiscono le rivendicazioni di indipendenza politica delle singole regioni e fino a che punto il diritto interno è in grado di riconoscere la possibilità di modificare i confini esterni compatibilmente con l'assetto costituzionale.
