If banking is the capability of an intermediary to link people in surplus with others able to pay for a temporary transfer of money, then the utility of this activity goes beyond the individual profit to benefit the whole community. Nowadays, the regulation does not foresee a fair sharing of this benefits among banks' shareholders, managers and the market. There is no rule to avoid banks' extra-profits. This paper analyzes the European regulatory framework and the rules set for transparency, safe and sound management of the financial intermediaries by pointing out the experience arising from the Crisis and the role of the speculative attacks. In the end, this research starts an analysis on the contemporary organization of capital markets by asking whether there is a religious base or not and which is the role of the last Encyclical, Lumen Fidei, made by Papa Francesco.
